Terms and Conditions

By booking or participating in a tour and any related products or services (a “Tour”) with Travel with a Local in Nepal, DIWAS Photography (D. Photography) you (“you”) agree to these Terms & Conditions (the “Terms”).

The following Terms constitute a binding agreement between D. Photography and you. By booking a Tour you acknowledge that you have read, understand and agree to be bound by these Terms. Please read these Terms carefully. If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your party. For the purposes of these Terms, the following words have been defined below:

 “You” collectively refers to the customer booking a Tour, as well as all accompanying participants on a Tour who are bound by these Terms.

“Third Party Suppliers” means independent parties including but not limited to accommodation providers, tour and local guides, activity providers, air carriers and tour operators with which D. Photography makes arrangements to execute part or all of your Tour. Third Party Suppliers may also engage the service of local operators and sub-contractors.

“Tour Operator(s)” shall refer to D. Photography or identified agents of D. Photography. 

1. Bookings, deposits and payments

1.1 In order to make a booking, you must submit a completed and signed tour application (“Tour Application”) with a non-refundable deposit. Tour Applications may be found on the D. Photography website here. Your booking is confirmed and a contract exists when D. Photography or agent issues confirmation after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information to D. Photography. Please ensure that names are exactly as stated in the relevant passport.
You must be at least 18 years of age to make a booking.
1.2 If you are making a booking on behalf of another person or party, by completing the booking you represent and warrant that you have the authority and consent to bind said participant(s). You hereby agree to be the primary contact for the Tour booking and shall be personally responsible for all obligations hereunder.
1.3 All bookings involving a minor (under the age of 18) are subject to approval by D. Photography . Anyone under the age of 18 on the date of first travel is considered to be a minor. Minors must always be accompanied by an adult. One adult may accompany up to three minors. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, documentation and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. D. Photography will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals. Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behavior, wellbeing, supervision and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. D. Photography does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).
1.4 Unless otherwise stated, the Tour deposit is USD $1000.00 per person. Specific Tour services may require additional deposit funds and you will be notified as such by D. Photography .
1.5 Unless otherwise indicated, full Tour payment is due a minimum of 45 days prior to the start date of your Tour. If the final balance is not paid on or before the due date, D. Photography reserves the right to cancel the booking without further notice and without refund of any monies paid.
1.6 If the booking is made within 45 days of the start date of your Tour, full Tour payment is required at time of booking.
1.7 D. Photography accepts the following forms of payment: wire or bank transfer, check, Visa, MasterCard or American Express.
1.8 You represent and warrant all information provided to D. Photography is complete, accurate and up-to-date, and you agree to remedy any incorrect information as soon as possible. Please check your invoice and all other Tour documents carefully and report any errors. In the case of billing errors, D. Photography reserves the right to invoice you with correct pricing.
1.9 D. Photography will not be liable for errors or omissions in the information provided to complete a Tour booking, or for any resulting losses. If you fail to provide information D. Photography has requested, D. Photography reserves the right to cancel relevant parts of your booking and apply cancellation fees at its sole discretion.
1.10 All participants in Tour must show proof of vaccination for Covid-19. Participants are responsible for determining any additional vaccinations required for travel globally and to Nepal, specifically.

2. Travel insurance

2.1 You understand that travel insurance coverage is not included in the cost of Tour.
2.2 It is your sole responsibility to ensure you have the required comprehensive and appropriate travel insurance coverage. Trip cancellation and interruption insurance is highly recommended. It is your responsibility to make yourself aware of the terms of your coverage and any exclusions, including those that may apply to countries or regions included in a government advisory.
2.3. You agree to hold us harmless for your choice of purchase comprehensive and appropriate travel insurance or for any denial of claim by a travel insurer under your policy.
2.4 D. Photography proof of insurance from you, and failing to produce such confirmation may result in a cancellation of your booking at your own expense.

3. Client Information and Travel Documents

3.1 It is your sole responsibility to obtain up-to-date information to ensure that you have the appropriate travel documents required for entry, departure and travel through destinations included in your Tour. Some countries or regions may require travel documents, including but not limited to visas, proof of vaccination, proof of travel insurance and medical certificates signed by a physician. In the event of missing or defective documentation, or denial of visa, D. Photography will not be responsible for any losses or expenses incurred.
3.2 It is your sole responsibility to ensure your passport is valid for a minimum of 6 months after the last date of your Tour.
3.3 D. Photography may provide travel information or resources, such as information on travel documents or visa requirements. Such information is provided for your convenience only, and should not be relied upon as an authoritative source. D. Photography makes no representations, warranties or guarantees regarding the accuracy or completeness of such information and will not be liable for any errors or omissions.

4. Required Medical Information

4.1 You must provide any medical information reasonably requested by D. Photography and may be required to complete the Tour Operator’s medical information form (the “Medical Form”). Medical Forms are mandatory for Tours. If you have any pre-existing medical conditions which may impact your ability to travel, participate in a Tour, travel to remote areas without access to medical facilities or may adversely affect the experience of others on your Tour, you must return a Medical Form, signed by a licensed and practicing physician to D. Photography prior to or at the time of final payment for the applicable booking, simply for reference if needed.
4.2 You agree to complete the Medical Form honestly and to disclose all relevant medical information accurately and fully. D. Photography will maintain the information in accordance with the Tour Operator’s Privacy Policy available upon request.
4.3 D. Photography reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a Tour.
4.4 D. Photography reserves the right to deny you permission to travel or participate in any aspect of a Tour at any time and at your own risk and expense where D. Photography determines that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others.
4.5 Pregnancy is considered a medical condition and must be disclosed to D. Photography at the time of booking. D. Photography and subcontractors may refuse elements of travel to those who are over 33 weeks pregnant. D. Photography may refuse to serve anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.
4.6 In the event that you do not complete the required Medical Form or provide medical information reasonably required by D. Photography for any reason by the deadline indicated above, D. Photography reserves the right to cancel your booking and all applicable cancellation fees will apply.
4.7 You are responsible for assessing whether a Tour is suitable for you. You should consult your physician to confirm your fitness for travel and participation in any planned activities. You should seek your physician’s advice on vaccinations and medical precautions. D. Photography does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the Tour based on your own unique circumstances, limitations, fitness level and medical requirements.
4.8 Travel with D. Photography may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries you may visit on your Tour varies and D. Photography makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions. 

5. Special Requests

Any special requirements must be disclosed to D. Photography at the time of booking. D. Photography will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options outside a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to D. Photography at the time of booking but D. Photography cannot guarantee that dietary needs or restrictions can be accommodated. Any special requests or requirements do not form part of these Terms or the contract between you and D. Photography and D. Photography is not liable for any failure to accommodate or fulfill such requests.

6. Travel Advisories

6.1 By agreeing to these Terms, you acknowledge and fully understand that your Tour may be affected by government-issued travel advisories or directives advising against or prohibiting nationals of your country from traveling to certain countries or regions. New or additional advisories or directives may be issued from the time of booking up to and during travel. It is your personal responsibility to check government websites for the most current travel advisories and directives affecting your current and future travel plans. In signing up for a Tour affected by a travel advisory or government directive, you voluntarily assume the associated risks.
6.2 If a government advisory is issued for a region included in your tour, D. Photography may need to alter the itinerary, as described in these Terms.

7. Tour Prices

7.1 Unless otherwise indicated, all Tour prices are in US Dollars. If there is a conflict between prices given in USD and another currency, the USD rates shall prevail.
7.2 Tour prices are subject to change. If there is a conflict between the Tour price quoted at time of booking, and the Tour price advertised either through the D. Photography website or other media, the Tour price at time of booking shall prevail.
7.3 Tour prices may be impacted due to an increase in the costs of services provided by Third Party Suppliers or other local service providers, including but not limited to increases of airfares or taxes, or adverse changes in exchange rates. You agree that you are responsible for any such price increases.
7.4 Once the Tour is paid in full, you are protected from any increase in Tour price, except as specified below in these Terms.

8. Changes to Itinerary

8.1 D. Photography puts great effort into ensuring the accuracy of our itineraries. However, D. Photography reserves the right to change or omit carriers, flights, accommodation, Tour Host or any other services involved in the Tour, or to modify the itinerary and/or dates. Such changes will be made at the discretion of D. Photography in the event that a circumstance beyond D. Photography ’s control, or any logistical or other concern, prevents us from traveling safely, comfortably or enjoyably. In cases where accommodation has been changed, D. Photography will make efforts to provide a substitute accommodation of similar quality. If there are any major changes to your Tour (defined as affecting at least one in three days of travel), D. Photography will endeavor to inform you as soon as reasonably possible, providing there is sufficient time to do so before departure. Such changes can also happen after a Tour has already started and without prior notice. In such cases, D. Photography will make reasonable efforts to provide substitute services of similar quality, but makes no guarantee.
8.2 You will be responsible for any costs associated with the changes described in 8.1. D. Photography will not be liable for any indirect and/or consequential losses associated with any changes to the itinerary, Tour dates or Tour services, nor will any necessary omissions be refunded.
8.3 Changes made by you to the itinerary or Tour services are subject to availability and approval by D. Photography , and may be accompanied by a fee. You will also be responsible for any price difference in services or fees levied by Third-Party Suppliers. 

9. Tour Services 
9.1 Single Travelers (a) You agree that in certain destinations, due to limited accommodation, single rooms may not be available and room share may be required. 
9.2 Participant’s Responsibility (a) In signing up for a Tour, you confirm that you have assessed the risks and requirements of each aspect of the Tour based on your fitness and medical needs. If you are signing up for a Tour on behalf of or accompanying a minor, you are responsible for determining that the minor is fit to travel on the Tour. D. Photography advises consulting with a physician regarding your fitness to travel, and the administration of recommended vaccinations and medical precautions. It is your responsibility to consult government medical recommendations regarding travel to your destination. (b) Some Tours have restrictions or minimum requirements, such as minimum and/or maximum age requirements. It is your responsibility to ensure you and all accompanying participants meet said restrictions and requirements.(c) If you have any pre-existing medical conditions which may impact your ability to participate in a Tour, or travel to remote areas without access to medical facilities, you have a responsibility to disclose this condition and its impacts to D. Photography in writing at the earliest possible opportunity. D. Photography will make reasonable efforts to accommodate pre-existing medical conditions, but cannot guarantee it can accommodate in all cases, and is not liable in the event it is unable to do so. If Tour activities are missed in relation to a medical condition, no refunds will be issued. Some Tours may require you to complete a medical form or present a form signed by a physician. Failure to disclose medical information in accordance with these Terms may result in a penalty determined at D. Photography ’ sole discretion, up to and including the cancellation of the Tour without refund.(d) It is your responsibility to educate yourself on and adhere to the local rules and regulations, including health orders, of your home jurisdiction and the jurisdictions included in the Tour, and refrain from carrying objects which violate said rules and regulations. It is also your responsibility to abide by the authority of D. Photography Tour Hosts, if any, as well as any local agents or guides.(e) D. Photography has the right to deny your participation in any aspect of the Tour at its discretion if D. Photography finds your physical or mental condition renders you unfit for travel or a specific service of the Tour, you refuse to follow D. Photography  directives, you interfere with the wellbeing or mobility of other travelers or staff, or you are in violation of these Terms. Please note that this may happen before or after the Tour commences. You will be responsible for any resulting expenses or losses.


10. Validity
All dates, itineraries and prices of Tours are subject to change at any time and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be levied in accordance with these Terms.
You acknowledge that you are responsible for keeping up to date on the specific details of your Tour and any other products or services, including, but not limited to checking the Tour Operator’s website at least 72 hours prior to departure as minor changes may have been made after the time of booking.

11. Deposits

At the time of booking, a deposit (“Deposit”) of $1000.00 USD per person per Tour is due to the Tour Operator. The deposit should be submitted to D. Photography and deposits are non-refundable . If the booking is made 30 days or less prior to departure, full payment is due at the time of booking.
If you cancel your booking, and that cancellation is not a result of nonpayment or any other breach of these Terms, the Deposit will be held with D. Photography, subject to these Terms. Non-refundable Deposits have no expiry and may be applied towards payment of a deposit on a future Tour offered. The Deposit is transferable and may be transferred by you to another individual of your choosing by providing notice to D. Photography in writing within one year. Deposits held from Tour cancellation but not applied to a new Tour within twenty-four (24) months shall be forfeited to D. Photography. 

12. DETAILS REQUIRED FOR BOOKING

As a condition of booking, you must provide the information requested by D. Photography along with final payment within the articulated timeline. If you fail to supply information required by D. Photography for air tickets, permits, or other inclusions, you will also be liable for any costs, fees or losses including failure to obtain or provide that inclusion. In the event that you fail to supply information required by D. Photography as Tour Operator, D. Photography also reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable, in its sole discretion. The information required by D. Photography will vary by Tour and will be communicated to you during the booking process. D. Photography will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.

13. Airfare

Tour prices do not include domestic, international or other airfare.

14. Final Payment + Acceptance of Booking

The confirmation sent by D. Photography will contain details of final payment required for any booking. Payment of the balance of the price for any products or services booked is due 45 days before the initial tour date. If full payment is not received by the applicable due date, D. Photography may, at its sole discretion, change the rate payable for the booking, or treat the booking as cancelled and retain the deposit paid on booking as a cancellation fee. If a booking is made less than 45 days before the departure date of the first product included in the applicable booking, then the full amount must be paid at the time of booking. If, for any product or service booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you prior to booking and will also be detailed on the applicable invoice.

D. Photography is not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to the f.

15. Cancellation
You may cancel your booking by notifying the Tour Operator. Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received by D. Photography and are expressed as a percentage of the total price paid for the cancelled Tour, product or service.(a) Cancellation received 60 days or more before departure of first product or service in relevant booking: Deposit will be held by D. Photography in accordance with these Terms, the remainder of the payments made to D. Photography in respect of the cancelled product will be refunded.(b) Cancellation received 30-59 days before departure of first product or service in relevant booking: Deposit will be held by D. Photography in accordance with these Terms, an amount equal to 50% of the remainder of the payments made to D. Photography in respect of the cancelled Tour will be refunded.(c) Cancellation less than 30 days before departure of first product or service in relevant booking: Deposit will be held by D. Photography in accordance with these Terms, and no further refund will be payable.
(d) Cancellation due to Covid-19 of participant less than 14 days before departure of first service in relevant booking requires certified doctor’s notice, 75% outside of non-refundable deposit will be refunded or applied to future tour.

16.
 Force Majuere
In the event either party is unable to perform its obligations under the terms of this Agreement because of acts of God, strikes, epidemic, government civil action, equipment or transmission failure or damage reasonably beyond its control or other causes reasonably beyond its control, such party shall not be liable for damages to the other for any damages resulting from such failure to perform or otherwise from such causes. A Force Majuer event shall not predicate the required return of a Deposit. 


17. Guaranteed Departures + Cancellation of a Tour by the Tour Operator
A departure date for a Tour offered by D. Photography will become a guaranteed departure when at least one booking secured by a valid deposit has been made on that departure.
D. Photography guarantees that all scheduled Tour departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure. Up to date Tour and itinerary information is available on the website or by contacting the Tour Operator. Brochures and other printed materials displaying Tour information and departure dates are subject to change may not be relied upon for purposes of this guarantee.

If a Tour is cancelled by D. Photography before the date of departure for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from the Tour Operator:(a) a substitute Tour of future tour equivalent or superior value; or(b) a full refund of all monies paid for the cancelled Tour.

D. Photography is not responsible for any incidental expenses or consequential losses that you incur as a result of the cancelled booking including visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment, D. Photography reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where a significant element of a Tour as described cannot be provided after departure, D. Photography will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, D. Photography may provide you with a refund for unused products or services as determined in its discretion.

18. Travel Documents

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. You must have a passport that is valid 6 months after the last date of travel with D. Photography as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the Tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by D. Photography that is a direct result of your failure to secure or be in possession of proper travel documentation. D. Photography does not provide advice on travel documents and makes no representations or warrantees as to the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment and you agree that D. Photography is not responsible for any errors or omissions in this information.

19. Flexibility + Unused Services

You acknowledge that the nature of international travel requires flexibility and acknowledge that you will permit reasonable alterations to products, services or itineraries by the Tour Operator. The route, schedules, accommodations, activities, amenities and mode of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of D. Photography (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties). No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to no fault of the Tour Operator, including your removal from a Tour because of your negligence or breach of these Terms.

20. Changes

D. Photography may modify your itinerary where reasonably required in its sole discretion. If D. Photography makes a change affecting at least one in three full days of the itinerary or which materially affects the character of a product or service in its entirety (a “Material Change”), D. Photography will provide notice to you as soon as reasonably possible, provided that there is sufficient time to do so before departure.
Once a Tour has embarked itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort. Any changes are at the discretion of the Tour Operator. You acknowledge that you must have reasonable financial resources to cover incidental expenses during all travel with the Tour Operator, whether or not such expenses arise from a change of itinerary, and D. Photography is not liable for your failure to prepare adequately for travel and unforeseen circumstances which may arise during travel. D. Photography will not be liable for any indirect and or consequential losses associated with any changes to a booking or itinerary.
Changes made by you: You are responsible for ensuring that information provided to D. Photography is accurate and up-to-date. Any changes to your name on any booking are subject to the Tour Operator’s approval. Any changes to a booking depend on availability and are subject to the Tour Operator’s approval and these Terms. Any extra costs incurred for making the change will be charged to you along with an administrative fee. Cancellation of any Tour, product or service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms. No changes are permitted to any booking within 10 days of departure of the first product or service on the applicable booking.

21. Acceptance of Risk

You acknowledge that international travel and the products and services offered by D. Photography may involve a significant amount of risk to your health and safety. By traveling with D. Photography you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release D. Photography from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Tour itineraries or otherwise offered by the Tour Operator. D. Photography requires that you confirm your assumption of this responsibility by completing the participation waiver (the “Waiver”) prior to departing on your tour.

You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to countries with developing infrastructure. Standards of hygiene, accommodation and transport in certain countries where Tours take place are often lower than the standards you may reasonably expect in your home country or region. You agree that D. Photography is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where a Tour, product or service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.

You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on Tour or, if in the opinion of D. Photography (acting reasonably), your behavior is causing or is likely to cause danger, distress or material annoyance to others, D. Photography may terminate your travel arrangements on any product or service immediately at your expense and without any liability on the Tour Operator’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

You are responsible for any costs (including repair, replacement and cleaning fees) incurred by D. Photography or the Tour Operator’s suppliers for property damage, destruction or theft caused by you while on a Tour. You agree to immediately report any pre-existing damage to a representative of D. Photography and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.

You agree to take all prudent measures in relation to your own safety while on Tour including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither D. Photography nor its Third Party Suppliers (as defined herein) are liable for loss or damages caused by your failure to comply with safety instructions or warnings.

You agree to bring any complaints to D. Photography as soon as possible in order to provide D. Photography with the opportunity to properly address such complaint. You agree to inform your tour leader, another representative of D. Photography or the Tour Operator’s customer service department directly. D. Photography assumes no liability for complaints that are not properly brought to the attention of D. Photography and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a Tour must be received in writing by D. Photography within 30 days of the last day of travel of the booking in question.

22. Liability of Third-Party Suppliers
D. Photography makes arrangements with accommodation providers, activity providers, coach companies, transfer operators, tour and local guides, and other independent parties (“Third Party-Suppliers”) to provide you with some or all of the components of your booking. Third Party-Suppliers may also engage the services of local operators and sub-contractors. Although D. Photography takes all reasonable care in selecting Third-Party Suppliers, D. Photography is unable to control Third-Party Suppliers, does not supervise Third-Party Suppliers and therefore cannot be responsible for their acts or omissions. Any services provided by Third-Party Suppliers are subject to the terms and conditions imposed by these Third-Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the Third-Party Supplier. You acknowledge that Third-Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and D. Photography does not warrant that any Third-Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.

Photography is not liable and will not assume responsibility for any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party other than D. Photography and its employees. D. Photography is not liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or any independent contractors.

23. Optional Extras

“Optional Extras” refers to any activity, transportation, meal, product or service not expressly included in the Tour itinerary or price of the Tour and which does not form part of the Tour. You agree that any assistance given by the Tour Operator’s representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and D. Photography makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or any information provided by any representative of D. Photography regarding any Optional Extras. You release D. Photography from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking Optional Extras.

You acknowledge and agree that any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury or loss of or damage to property associated with Optional Extras is the sole responsibility of the third party providing that service or activity.
