This Privacy Policy describes how D. Photography Photography LLC dba Travel With a Local in Nepal

D. Photography (“D. Photography”) a Washington State limited liability company, will gather, use, and maintain your personal information for the purpose of booking travel photography services (the “Services”) offered through our website and including our marketing activities and social media. It will also explain your legal rights to control use of that information.

The Privacy Policy describes the privacy practices of D. Photography. 

What is personal information and how do we use or disclose it?
Personal information (“Personal Information”) is information about an identifiable individual, and includes your name, contact information, travel itinerary and other information described below. D. Photography collects this Personal Information for the purpose of booking Services either directly or through our agency and booking partners. 
The Information D. Photography Collects.

1. Information You Provide to Us
1.1.1 Personal Information. D. Photography collects personal information including your name, address, age, emergency, contact information, passport information, travel medical information (where provided), insurance details, ISIC information (where applicable), nationality, nutrition preferences, trip evaluations, travel and accommodation preferences, the comments you provide to D. Photography, trip destination information, approximate geographical location of your computer or mobile device, telephone, email address, billing and mailing information, and credit or debit card and other financial information that you voluntarily share when booking travel photography services with D. Photography. Information collected and required for completing booking from D. Photography may be shared with the third parties that facilitate the payment, fulfillment, and facilitation of said travel photography services.

2. Cell Phone Numbers. D. Photography may use your cell phone number to call or send recurring text messages to you, using an auto-dialer, prerecorded voice, or live person, in order to provide you notifications about Services, trip status or for marketing purposes (with your consent where required by law). You may be liable for standard SMS and per-minute charges by your mobile carrier. Data rates may apply.

3. Research and Marketing Data. D. Photography may collect research data that you provide to us when you agree to participate in our surveys following your participation in our Services. D. Photography may also collect marketing data, including your preferences for receiving marketing communications, and details about your engagement with us.
2. Personal Data Collected via Technology
2.2.Device Information. D. Photography collects information about the computer or device you’re using to access the D. Photography website, including but not limited to, the type of computer or mobile device you use, your mobile device’s unique device ID, the IP address of your computer or mobile device, your operating system, the type of internet browser you use, and information about the way you use the D. Photography website (“Device Information”). D. Photography may use Device Information to monitor the geographic regions from which users navigate the D. Photography website and for security and fraud prevention purposes.

2.3.Cookies and Other Technologies. When you use a website, mobile application, or other internet service, certain internet and electronic network activity information gets created and logged automatically. This is also true when you engage with the D. Photography website either by website or mobile app. Here are some of the kinds of information we collect:

2.  With Whom D. Photography Shares Your Information.
a. Third Party Service Providers. D. Photography relies on third-party agents to process transactions and book travel which requires D. Photography to share your information with those contractors, service providers and representatives of those agents, including:

Photography’s credit card payments are processed through Stripe. Their privacy agreement is located at https://stripe.com/privacy.
iii. Website hosting services. D. Photography’s website is hosted by GoDaddy and their privacy agreements are located at:  https://www.godaddy.com/legal/agreements/privacy-p..iv. Fraud detection services;
v. Third-party travel services and airlines.

b. Business Affiliates. D. Photography reserves the right to transfer, sell, and/or distribute all information collected through the D. Photography website to any D. Photography affiliate, subsidiary or third-party in the event of a merger, sale, reorganization, joint-venture, assignment, transfer, or other disposition of any or all of our business, assets, or membership units. In such event, any new entity will be required to follow this Privacy Policy with respect to your Personal Information as to the extent required by law.

c. When Compelled by Legal Obligations. D. Photography may disclose personal information including location data or communication data, to a third party if required to do so by law or pursuant to a court order, warrant or subpoena. D. Photography reserves the right to disclose personal information from both private and public areas of the Site in the absence of a court order warrant or subpoena if we are given reason to believe, in our sole discretion, that someone is causing injury to or interfering with the rights of users, the general public, or D. Photography or its partners, parents or affiliates.

It is D. Photography’s policy to provide notice to clients before producing their information in response to law enforcement requests unless (i) we are prohibited by law or court order from doing so, (ii) we have reason to believe the client’s profile has been compromised such that the notice would go to the wrong person, or notice would otherwise be counterproductive or would create a risk to safety, or (iii) it is an emergency request and prior notice would be impractical (in which case we may provide notice after the fact).  
If you book a D. Photography trip, D. Photography may rely on local service providers. Please be aware that D. Photography may be required to provide certain personal information to our service providers for the purposes of delivering your experience. For example, if you book flights through D. Photography, we will be required to provide certain personal information to the airline for the purposes of securing your ticket. When you book travel services with us, you consent to collection, use and disclosure of your personal information by D. Photography—and the corresponding collection and use by the relevant travel partners or suppliers—for the purposes of administering and delivering the travel services you requested. Your personal information may also be used for the purposes of:

  • Enabling us to better understand your needs as a customer and determine eligibility for our products and services;

  • Informing you about our products and services, or those of our partners that we believe may be of interest to you (provided that we have received valid consent from you, if such consent is required);

  • Providing ongoing service and support, including resolution of any issues with the services or products you request from Travel with a Local in Nepal : D. Photography Photography;

  • Ensuring the safety and security of our passengers and products;

  • Carrying out internal accounting and administration of our business;

  • Complying with laws, regulations, and immigration requirements

3. How is your personal information protected? 
We have implemented measures designed to help protect personal information in our custody and control. We maintain reasonable administrative, technical and physical safeguards in an effort to protect against unauthorized access, use, modification and disclosure of personal information in our custody and control. Unfortunately, no collection or transmission of information over the Internet or other publicly accessible communications networks can be guaranteed to be 100% secure, and therefore, we cannot ensure or warrant the security of any such information. We have personal information retention processes designed to retain personal information of our customers for no longer than necessary for the purposes stated above or to otherwise meet legal requirements.
4. D. Photography Information Retention Policy.
D. Photography retains your personal data for as long as you are a client in order to meet our service obligations to you, and for such longer period as may be in our legitimate interests and to comply with our legal obligations. We may also retain aggregate information beyond this time for research purposes and to help us develop and improve our services. You cannot be identified from aggregate information retained or used for these purposes. 
5. Children’s Privacy.
D. Photography does not knowingly or intentionally collect personal information from children under the age of 18 years old without parental consent. D. Photography is not marketed or directed towards children under 18 and those under the age of 18 are not permitted to book travel through the D. Photography website without the express consent of their parent or guardian. If D. Photography becomes aware that we have unknowingly collected the personal information of a child under the age of 18, D. Photography will delete all of the associated personal information unless expressly communicated otherwise by the child’s parent or guardian. 

6. Notifications of Changes to D. Photography’s Privacy Policy.
As D. Photography updates and expands the facilitation and delivery of their website and travel photography services, D. Photography’s Privacy Policy may be periodically reviewed and enhanced as necessary. D. Photography will endeavor to notify you of any material changes by email. You are also encouraged to review D. Photography’s Privacy Policy periodically.

D. Photography will respond to all requests sent through mail or email from Guests and parents of Guests with questions about privacy or the types of personal information is stored on the D. Photography database, or requests to nullify such personal information.

8. Information for California residents.
In compliance with the California Consumer Privacy Act (“CCPA”), this section describes how we collect, use, and share the Personal Information of California residents online and offline in our capacity as a “business” under the CCPA. As a California resident, you have the rights listed below. However, these rights are not absolute and D. Photography may, in certain cases, decline your request as permitted by law. 
8.1 Information. You can request the following information about how we have collected and used your Personal Information during the past 12 months:
a. The categories of Personal Information that we have collected.
b. The categories of sources from which we have collected Personal Information.
c. The business or commercial purpose for collecting and/or selling Personal Information.
d. The categories of third parties with whom we share Personal Information.
e. The categories of Personal Information that we sold or disclosed for business purposes.
f. The categories of third parties to whom the Personal Information was sold or disclosed for a business purpose.


Additionally, you can request a copy of the Personal Information we have collected about you during the past 12 months. You can ask us to delete the Personal Information we have collected from you. You can opt-out of any sale of your Personal Information and you are entitled to exercise the rights described above free from discrimination as prohibited by the CCPA.
